Cebuano news: Bag-ong mining policy nahisubay sa national laws

SURIGAO CITY, Hulyo 10 (PIA) -- Ang bag-ong mining policy nagtinguha sa pagseguro nga ang gipagawas nga mga ordinansa sa mga local government units (LGU) nahiuyon sa national laws kalabot na sa mina, si Environment and Natural Resources Secretary Ramon Paje miingon.

"What the EO (Executive Order No. 79) is saying is that somehow there must be consistency between national laws and local laws. And, of course with this, the local ordinances cannot be against national policies," sulti ni Paje atol sa regular press briefing didto sa Malacanang kagahapon Lunes.

Pirmado na ni Pangulong Benigno S. Aquino III niadtong Hulyo 6, 2012 ang Executive Order No. 79 (Institutionalizing and Implementing reforms in the Philippine mining sector providing policies and guidelines to ensure environmental protection and responsible mining in the utilization of mineral resources).

"Sec. 12 (of EO No. 79) recognizes the need for national laws and local ordinances to be harmonized to ensure the proper management and regulation of the mining industry," pagpasabot ni Paje.

Ang maong EO nagtinguha usab aron ipahiluna ang tagsa-tagsa ka mga tahas sa national government ug mga local government units (LGUs) kalabot na sa mina.

Sa paghimo sa maong EO, ang national government maoy mokoordinar ug mokooperar sa LGUs sa pagseguro sa angay nga implementasyon kalabot na sa mga mining related laws, rules ug regulasyon, labi na ang small-scale mining.

Ang mga hintungdang ahensya sa gobyerno adunay direktiba aron tun-an ang posible nga mga legislasyon pagpauswag sa LGU shares gikan sa maong mga resources ug paghatag sa mga mekanismo aron madali ang pagpagawas sa ilang mga shares pinaagi sa angay nga koordinasyon sa tagsa-tagsa ka mga ahensya.

Ang provincial/city mining regulatory boards (P/CMRBs) maoy motabang sa mga LGUs aron matarong ang small-scale mining ug mahatagan og saktong porum alang sa nagkalain-laing mga stakeholders. Ang local government units, matud sa EO, mahimong parte sa Mining Industry Coordinating Council (MICC) aron pagseguro nga matubag ang ilang mga kabalaka.

"But if there are local ordinances, like the one in South Cotabato—it remains valid because there is a process in invalidating it. It remains valid until it is invalidated by competent authorities or through the courts," sulti ni Paje.

Ang national government adunay direktiba sa EO pinaagi sa Department of Interior and Local Government, aron makigtambayayong sa mga LGUs aron pagseguro nga ang mga local ordinances nahisubay ug uyon sa mga balaodnong nasyunal, ug mga polisiya, aron pagseguro usab sa angay nga implementasyon sa maong mining act.
